【音頻解讀】《持永久居留身份證外籍人員創(chuàng)辦科技型企業(yè)試行辦法》政策解讀 持永久居留身份證外籍人員創(chuàng)辦科技型企業(yè)試行辦法 window.audiojs.events.ready(function() { window.audiojs.create(document.getElementById("audio_94622782836996430")); }); 　　一、背景依據(jù)　　根據(jù)《中共中央國務(wù)院關(guān)于深化體制機(jī)制改革加快實(shí)施創(chuàng)新驅(qū)動(dòng)發(fā)展戰(zhàn)略的若干意見》（中發(fā)〔2015〕8號(hào)）和中共中央、國務(wù)院印發(fā)的《粵港澳大灣區(qū)發(fā)展規(guī)劃綱要》的精神，市科技局會(huì)同市發(fā)展改革委、市場(chǎng)監(jiān)管局等單位研究制定了《持永久居留身份證外籍人員創(chuàng)辦科技型企業(yè)試行辦法》（以下簡(jiǎn)稱《試行辦法》）。此項(xiàng)政策的出臺(tái)，將進(jìn)一步便利外籍人才在穗創(chuàng)新創(chuàng)業(yè)，為進(jìn)一步優(yōu)化廣州市營商環(huán)境，支持持有外國人永久居留身份證（外國人永久居留證）的外籍人員以科技創(chuàng)業(yè)方式參與粵港澳大灣區(qū)國際科技創(chuàng)新中心建設(shè)提供政策指引。　　二、試點(diǎn)區(qū)域及時(shí)間　　《試行辦法》在廣州市全市范圍內(nèi)實(shí)施。《試行辦法》自2021年8月1日起實(shí)施，試行期為3年。　　三、政策主要內(nèi)容　　（一）《試行辦法》僅針對(duì)特定群體的特定事項(xiàng)的特定權(quán)益，即“持有中華人民共和國外國人永久居留身份證（外國人永久居留證）的外國自然人”在創(chuàng)辦“科技型企業(yè)”方面享受國民待遇。　　（二）外籍人員創(chuàng)辦企業(yè)的待遇方面，是指外籍人員可憑其持有的外國人永久居留身份證（外國人永久居留證）作為創(chuàng)辦科技型企業(yè)的身份證明，與境內(nèi)自然人持中國居民身份證作為身份證明創(chuàng)辦企業(yè)享受同等待遇，并根據(jù)《中華人民共和國外商投資法》及其實(shí)施條例等相關(guān)規(guī)定辦理商事登記。　　（三）《試行辦法》還明確了注冊(cè)企業(yè)的類型。本辦法僅限于注冊(cè)的企業(yè)類型為科技型企業(yè)。所指的科技型企業(yè)是指從事技術(shù)開發(fā)、技術(shù)轉(zhuǎn)讓、技術(shù)咨詢、技術(shù)服務(wù)、技術(shù)檢測(cè)或高新技術(shù)產(chǎn)品（服務(wù)）研發(fā)、生產(chǎn)、經(jīng)營的企業(yè)。企業(yè)可以從事科技及科技相關(guān)的行業(yè)。注冊(cè)的企業(yè)類型可選擇注冊(cè)為股份有限公司、有限責(zé)任公司、合伙企業(yè)。　　（四）《試行辦法》還提出了鼓勵(lì)技術(shù)創(chuàng)新。鼓勵(lì)外籍人員以自有知識(shí)產(chǎn)權(quán)、專有技術(shù)等非貨幣財(cái)產(chǎn)作價(jià)出資創(chuàng)辦科技型企業(yè)。　　（五）《試行辦法》還明確了外籍人員創(chuàng)辦科技型企業(yè)時(shí)，應(yīng)按照有關(guān)規(guī)定向市場(chǎng)監(jiān)督管理部門辦理注冊(cè)登記。　　[ The Chinese version shall prevail for the final interpretation of these Measures, and the English translation is for reference only. ]　　Trial Measures for the Establishment of Scientific and Technological Enterprises by Foreigners with Permanent Resident ID Card　　Article 1 These Measures are formulated in accordance with the Several Opinions of the CPC Central Committee and the State Council on Deepening the Reform of Systems and Mechanisms to Accelerate the Implementation of Innovation-driven Development Strategies to further optimize the business environment of Guangzhou City and support foreigners holding Foreign Permanent Resident ID Card (Foreigner’s Permanent Residence Card) to participate in the construction of international science and technology innovation center in Guangdong-Hong Kong-Macao Greater Bay Area by means of scientific and technological entrepreneurship.　　Article 2These Measures shall be applicable in Guangzhou.　　Article 3 The foreigners with permanent resident ID cards referred to in these Measures are foreign natural persons who have been approved to obtain permanent residence status in China and hold foreign permanent resident ID cards (foreigner’s permanent residence cards) of the People's Republic of China.　　Article 4The foreigners with foreign permanent resident ID cards (foreigner’s permanent residence cards) to establish scientific and technological enterprises shall receive the same treatment as domestic natural persons, that is, foreigners can use their foreign permanent resident ID cards (foreigner’s permanent residence cards) as proof of identity to establish scientific and technological enterprises, and enjoy the same treatment as domestic natural persons holding Chinese resident ID cards as proof of identity. Commercial registration shall be undertaken according to the Foreign Investment Law of the People's Republic of China and its implementing regulations.　　Article 5The scientific and technological enterprises referred to in these Measures are enterprises engaged in technology development, technology transfer, technology consultation, technology services, technology testing or R & D, production and operation of high-tech products (services). Enterprises in this category may be engaged in technology and technology-related industries. They may be registered as joint stock limited companies, limited liability companies or partnership enterprises.　　Article 6 Foreigners are encouraged to invest in the establishment of scientific and technological enterprises with their own intellectual property rights, proprietary technology and other non-monetary assets.　　Article 7 The foreigners with foreign permanent resident ID cards (foreigner’s permanent residence cards)  to establish scientific and technological enterprises shall apply to the market supervision and administration department for registration.　　Article 8These Measures also apply to the case of new foreigners holding permanent resident ID cards as investors.　　Article 9 These Measures shall come into force from August 1, 2021 and shall be valid for 3 years.
